By accessing or using the TerrainOne app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access or use the App.

1. Introduction

Welcome to TerrainOne ("App"), operated by TERRAINONE PTY LTD ("we," "us," or "our"). These Terms govern your use of the App and any related services provided by us.

2. Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so may result in the termination of your account. You are responsible for safeguarding your password and any activity under your account.

3. Intellectual Property

The App, its original content, features, and functionality are the exclusive property of TERRAINONE PTY LTD and its licensors. Our trademarks and trade dress may not be used without prior written consent.

4. Links to Third-Party Websites

Our App may contain links to third-party websites or services that are not owned or controlled by TERRAINONE PTY LTD. We are not responsible for the content, privacy policies, or practices of third-party websites or services.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, your right to use the App will cease. You may terminate your account by selecting Delete Account in the Settings Menu.

6. Limitation of Liability

To the maximum extent permitted by law, TERRAINONE PTY LTD, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from:

Your access to or use of (or inability to access or use) the App; any third-party conduct or content on the App; any content obtained from the App; unauthorized access, use, or alteration of your content.

This limitation applies regardless of the legal theory (e.g., contract, tort, negligence) and even if we have been informed of the possibility of such damages.

7. Disclaimer

Your use of the App is at your own risk. The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Age Restrictions

TerrainOne is intended for users aged 13 and above. Users under 18 must have parental consent to use the App.

9. User-Generated Content

Users are responsible for any content they submit. We reserve the right to remove content that violates our policies, including offensive, harmful, or illegal material.

10. Subscriptions & Auto-Renewal

Some features require a subscription. Subscriptions renew automatically unless canceled at least 24 hours before the renewal date. You can manage subscriptions in your Apple or Google account settings.

11. Refunds & Cancellations

If you purchase a subscription or in-app content, you can cancel at any time via the App Store or Google Play settings. Refunds are subject to the policies of Apple and Google.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is significant, we will attempt to provide at least 30 days' notice before the new Terms take effect. The determination of what constitutes a significant change is at our sole discretion.
